The protection of new plant variety has a bearing on the economic development and the science and technology advance of a country, a region or a company. Agriculture, an industry vital to people's livelihood, has become a hot spot for the world competition. China is a big agricultural county but agriculture is at a disadvantageous position even though it is the foundation of our nation's economy and concerns with the social stability and safety of people's life. At present, there are many problems found in new plant variety protection: the low protection awareness, the disorder in market management, frail implementation of law, the difficulty in secrecy of multiplying seeds. Therefore, we must build up a new plant varieties protection institution so as to protect our superior product, to protect our rich plant varieties and the profit of scientific and technical workers in this field. This institution also plays an important role in helping to solve those problems concerning agriculture, countryside and farmers and strengthening the competitiveness in world market.This paper firstly introduced the origin and development of the protection institution of new plant variety, look ahead into its trend of development globally in the new era. Then the author analyzed the progresses in recent years and deficiencies in the protection of new plant varieties in China when compared with some foreign countries. It warns us that in the intellectual era it is urgent to raise the awareness of new plant varieties protection and to perfect the protection institution when facing the international competition. Then it mainly analyzed the features of new plant varieties and their value, content, mode of protection and the conditions for the grant of certificate. It helps people understand the concept of the new plant varieties and provides the basis and references for new plant variation protection from both theory and practice. Finally, some countermeasures were put forward to solve the current major problems of new plant varieties protection: to raise the public awareness of new plant varieties by learning and publicizing the laws and regulations; to reinforce the implementation of law and normalize the market so as to protect the breeder's rights and profits; to complete the protection system and to improve the enforcement environment of the new plant varieties protection institution; to take part in international exchange and to do more researches on new plant varieties to meet the need of our agricultural development in the new era.
