A Research On Legal Safeguard Of Woodland Resource Security

According to the classification of Land Management Law, agricultural land resources include woodlands. At present, the protection of woodlands has been strengthened and the percentage of forest cover has increased. As the economy in China is developing with a high speed, the steps of urbanization is speeding up, due to which urbanization conversion from woodlands into non-woodlands is always a problem. At the same time, the development of economy inevitably expands the need for various raw materials including forest products. So the risk that the woodland resources may be damaged in our country is always a problem and the problem is getting bigger and bigger. Woodland resource security is achieved when woodland resources satisfy social needs. Through my investigation into the laws of our country, I find out that neither the management of woodland resources through laws in China is satisfying, nor the exploitation of woodland resource market both at home and abroad is perfect. Economic regulation is focused on more than administrative regulation in the laws of woodland resource security in China. However, with the development of China's market economy, the purpose of regulating woodland resource security is more and more difficult to achieve by administrative regulation. In order to secure woodland resources through economic means, existing laws should be revised or new laws be made.In consideration of the regulation of the laws of woodland resource security in China, this thesis is analyzed in the following parts:In the first part, the theory of woodland resource security is introduced. Through the introduction of research background, various basic theories of woodland resource security, which mainly include the definition, explanation, viewpoints and value of woodland resource, is put forward. Some basic theories are also introduced in this part. That the state should make efforts in macro-control and microeconomic-control through economic means is stated. And thus, due to the adjustments of economic interest, subjects involved in economic activities will abide by the laws voluntarily.In the second part, the disadvantages of the existing laws of woodland resource security in our country are discovered and related laws from abroad are introduced. The standpoint of this thesis is economical behavior. And the holes in China'laws are revealed through observation on that how China's laws guarantee woodland resource security in the aspects of production, consumption, and import and export trade. At the same time, legislations and regulations of woodland resource security in Japan, Finland, and Germany as references consulted during the perfection of China's laws are focused in this part.In the third part, legislative suggestions focusing on the problems discussed in the second part are thrown out. Specific measures are put forward to solve the problem of perfecting laws of woodland resource security in China. Suggestions are made to legislate for the aspect of production, consumption and import and export trade and to improve the coordination of various laws and regulations in China.
