A Study On Translator's Creativity In The Translation Of Legal Terminologies

This paper discusses translator's creativity in the translation of legal terminologies. It discloses the active and subjective role of legal translators in the whole process of term analyzing and decision making. This paper also introduces a new approach based on Peter Sandrini's theory which derives from the theory of comparative law to the translation of legal terminologies. The thesis first gives a brief view of translation of legal terminology and proposes the research questions which- are answered in the following chapters. And then by conducting literature review, this thesis-introduces different translation theories and discloses their deficiencies. Under the theoretical framework proposed by the author, this paper first categorizes illusions and difficulties that translators meet in the translation process, and then it discusses how to avoid the illusions and difficulties in translation process by applying comparative law study combining with pragmatic translation strategies. This paper employs many examples to illustrate the decision-making process in translation. By analyzing the decision-making process, the thesis discloses translators' active role in both making legal choices and making linguistic choices. Thus translators' creativity is revealed. Finally, this thesis uses many translation samples to illustrate different kinds of useful strategy that translators can use after comparative law study.
