Protecting the intangible cultural heritage is intricate work, challenging and prospective. One kind of practical methods is to make use of intellectual property mechanism available. This thesis based on the characteristic of intangible cultural heritage in Hunan, analyzed the current protecting situation and deficiencies. On this basis, put forward the basic ideas and specific measures of intellectual property protection of intangible cultural heritage in Hunan.The objects of intangible cultural heritage which can be protected by intellectual property, including folk literature and art, traditional knowledge and traditional discriminating symbols. Firstly, this thesis expounded how to make use of intellectual property to protect the three objects mentioned above. Then, I have arranged the abundant intangible cultural heritage in Hunan, discussed the necessity of protecting them by intellectual property, and classified them from intellectual property objects. On this basis, I have analyzed the current situation of the protection of folk literature and art, traditional knowledge and traditional discriminating symbols in Hunan through intellectual property, found out the deficiencies and causes. According to the deficiencies and causes, discussed the perfecting of intellectual property protection system of intangible cultural heritage in Hunan, have given some practical suggestions about how to improve the protecting level, For example, about the protecting of the folk literature and art by copyright in Hunan, have resolved the problem of how to handle the right relationship of recording work, adapting work and the primitive work mainly. To the protection of Hunan traditional knowledge, have given some useful suggestions about how to carry out the propaganda and education activity on the patent right and business privacy protection of tradition knowledge in Hunan, reformed the helping and encouraging measures taken by the government. And, told how to construct Hunan traditional technology data base. About the protection of traditional discriminating symbols, have contributed a systemic scheme, from the protection strategy of the brand of Hunan old and famous shop to the application and management work of Hunan geographical indication right.
