| Wenxi is located in the northeast of Yuncheng City in Shanxi Province.Since ancient times,the land has had the saying “There must be something and there must be something.” This is the word for Wenxi Huayu and Wenxi Huayu.Being listed as a national intangible cultural heritage,as a province with high economic value and intangible cultural heritage in Shanxi Province,with the development of the economy,relying solely on public law protection cannot meet the needs of intangible cultural heritage.From the perspective of intellectual property rights,it is necessary to study the problems faced by the protection of intangible cultural heritage in the application of the intellectual property system and solutions.Shanxi Province is located in the birthplace of the Yellow River civilization.Its geographical location has precipitated civilization for thousands of years.People growing on this land have formed distinctive intangible cultural heritage in long-term work life,such as Wutai Mountain Foyue and vinegar brewing.The intangible cultural heritage such as arts,the art of brewing spring liquor from pear flowers,Quwo flower gourd,and several kinds of local opera dramas,these intangible cultural heritages are an important force for the transformation and development of Shanxi.However,despite the abundance of abundant intangible cultural heritage in Shanxi Province,there are some intangible cultural heritages with relatively low economic value.These intangible cultural heritages are facing the demise and no one inherits the traditional skills;the other part is suitable for development.The intangible cultural heritage rich in economic value lacks the unreasonable development of the government.There are more and more abuses of intangible cultural heritage by the public.In this paper,two research methods,literature research and comparative analysis,are used in the writing process.The article consists of four parts.The first part discusses the reasons.The second part deals with the conflict.The third part is On the basis of the foregoing,the comparative analysis offoreign non-material cultural heritage,further summarized the intellectual property protection model suitable for China’s intangible cultural heritage.In the second part of the reasons for our province’s intangible cultural heritage intellectual property protection put forward their own recommendations. |
