Beginning with the definition and Characteristics of trust, it states the definition and creation of charitable trust, To create a charitable trust, two special essentials are needed. And there are two principles in charitable trust: the first is he CY-pres Doctrine? The second is o Rules Against Perpetuities? With comparing, the distinctions between registration system and admission system are evident. With observing the history and new development of the function of charitable trust, the Charitable trust has three advantageous functions: safety, high efficiencies and low cost. secondly, observing the business of function, it finds the using of charitable fund has three disadvantages. Finally, the author raises introduction of charitable trust system to China. Comparing juridical person system to Charitable trust system, it concludes that introduction of Charitable trust system to China is very needed and urgent. On Charitable trust law-making, it has its own ideas on structure, definition, supervising and so on.
