The market mechanism and the business sector have created tremendous wealth for the world's leading entrepreneurs using highly skilled expertise,but the allocation of wealth has not been so effective.Therefore,it requires other operating mechanisms and departments to redistribute wealth.Throughout the development of efficient redistribution of wealth abroad,charity is the primary choice for most wealthy people.Under the background of China's first charity law,this paper intends to explore the legal issues related to the development of charity from both home and abroad.On the basis of previous studies,comparison of China philanthropy development related system the progress and shortcomings of the development through the analysis of foreign families to join the charity of choice of different mature system and the current domestic wealthy family charitable trusts for practical value.With the development of our country's charitable status,family related policies,supervision mechanism,tax incentives,research and development Chinese family wealth in the field of charity in the "trust+foundation" as the function and significance of local development mode and related system,in order to provide better measures to improve the development of domestic family charity.This article mainly from the four part of the Family Charitable Trust&Foundation: origin,development,reference and perfection of legislation,and finally develop some specific system.The first chapter introduces related concepts,function value historical development of charitable foundation and charitable trust,then,this paper is combining with analysis of the rapid growth of China's high-net-worth individuals and the realistic background of the ? charity law ?,following the history and characteristics of family charity to pave the way.In the second chapter,the author makes an empirical analysis and summary on the legal supervision and the realization mode of the Family Charitable Fund.First of all,it mainly introduces the relevant laws and policies of the United States and Britain on charitable trust supervision;Secondly,this paper illustrates the mode and value of the combination of family trust and charitable trust.Finally,through the introduction of the successful model of foreign family wealth management and a brief analysis,the author combines with domestic demand to choose the most appropriate as a local development model.Furthermore,in the third and the fourth chapter,the author gives a detailed explanation of the development dilemma,legislative status and practical value of China's Family Charitable Trust&Foundation,meantime including the perfection of the legislation system.The key is not only the case analysis on the domestic typical examples and the paper explores the value of combination with charitable trust and the foundation function,also on the basis of foreign successful mode in order to the perfection of the legislation system.Above all,based on the local development and the implementation of specific regulatory system,the paper intends to promote the effective development of China's Family Charitable Trust&Foundation.
