China's Anti-monopoly Legislation

The thesis mainly approaches China's anti-monopoly legislation problems from macroscopic angle with today's planned economy to market economy system as background.The first part presents the history of anti-monopoly legislation. By scanning the history of anti-monopoly legislation, especially by presenting the history of it, the thesis gives us a general knowledge about the state of anti-monopoly legislation in modern or ancient times, in China or elsewhere, and makes deep analysis on the basis of it, thus reveals the common reason and generality of anti-monopoly legislation. In modern sense, the symbol of anti-monopoly law's production is America's Anti-Trust Act in 1890. From then on, anti-monopoly legislation gradually becomes systematic, complex .The second part deals with the necessity of China's anti-monopoly legislation. It discusses the necessity from different angles. First, it carries out from the reasons that people differ from about the necessity of legislation. Next, it concretely analysizes the necessity of legislation. Once time, it analysizes the view of "economy develop standard" and "scale economy" held by some people who are against anti-monopoly legislation. Finally, it illustrates the urgency of Chinese anti-monopoly legislation.The third part talks about the theory preparation and practice basis of anti-monopoly legislation. This part makes objective analysis and appraisal about the theory and practice of Chinese anti-monopoly legislation, it affirms achievement as well as points shortcoming, thus illustrates that we must enrich our theory and practice of anti-monopoly law constantly on the basis of present achievement in order to draw up a perfect anti-monopoly law.The fourth part tells about the construction of Chinese anti-monopoly law. This part discusses some common questions on Chinese anti-monopoly legislation, including the legislation of guiding ideology and style, legislative power and legislation form, interest protect structure and value-seeking ,then sketches the outline of Chinese future anti-monopoly law with thick lines, finally talks about the basic conception of Chinese anti-monopoly legislation.
