Research On Patent Protection Of Computer Software

The development of the software industry has been playing an important role in the whole computer industry. Although software has been protected by the Copyright Law in many countries,because of the computer software itself possessing the ready reproducibility and the ready imitatability of design thought,more and more infringing cases concening software occurred and many cases cann't be solved by the Copyright Law in the practice,which is disadvantages to protect software effectively.Therefore,industry and law field in many countries have to renovate and seek new law path to efficient software protection.Many schoolars in our country have been making great efforts for it.On the basis of the studies on the present law system and trend of the computer software protection,the author analyzed the feasibility and effectivity of software protection by Patent Law referring to the principle and charictristics of economics and Patent Law .Futhermore,in view of present situation of china ,the author point out constructive legislative advice on some issues.
