The remarkable Uruquay Round which started in 1994 has finally come to an end with the fruitful result that all the parties have agreed on the trade in goods, trade in service ,the protect of intellectual property rights and trade-related measures etc .As a result of the union of the world economy and the continuation of the GATT(General Agreement of Tariffs and Trade),the GATS has an very important and far-reading effect on the improvement of order of the international economy and the economic exchange .The signing of the GATS indicates that the international trade system has been coming to be perfect .Since China began to carry out the Reform and Open Policy in 1978 and especially since China took pant in the negotiation for re-entering the GATT and the one in Uruquay Round ,China has been having the problem to open the trade market in service .As one of the signatories to the GATS and with the liberalization of the international trade in service and the acceleration of our entering the WTO ,how to improve the trade in service in China and the legislation in the field has become one of the important steps to further the open policy in China .From the view of law , this essay will comment on the basic structure ,the principle and the main content of the GATS .It also raises some advice on the legislation in the trade in service in China by making an analysis on the rights and duties in the field of the trade in service China should undertake and the effect that will be brought to China if China enters the WTO.
