The Research Of Tourism Legislation In Our Country Under GATS Frame

With the development of productive forces and industrial structure, service commerce has expand quickly. It has gradually been the important power to drive the increasing world economy since1995. In December1990, GATS was passed through negotiations in Oriental Republic of Uruguay. GATS became a part of World Trade Organization and became officially effective in January1995. GATS stipulated the international service trade and concluded tourism service trade.GATS is not only a chance for China’s tourism but also a challenge. After several ten years’ development, our country’s tourism service trade has already become the top ten tourism country in the world, and also become one of the fastest developing countries for tourism. However, the lack of relative law obstructed the development of China’s tourism."The tourism law for the People’s Republic of China" hasn’t come into effective until today. Because of lacking sound law system, our tourism cannot get with the necessary of development.We should perfect our tourism service law under the frame of GATS and set up integrated tourism law system in order to promote our industry’s development. At the same time, our travelers’ rights were often violated and cannot find an effective way to protect owing to the lacking of rules. Our travelers’ rights become more and more important facing to the assault of GATS. It has been the key problem relating to the overall tourism development. This article consider GATS as the entry, primarily analyze and estimate the tourism law and the protection of travelers’ rights.
