| A bareboat charterparty is a lease contract, thus the concerned provisions in Chinese Contract Code shall apply upon it .In the event that there are specific provisions in Chinese Maritime Code as to the rights and obligations of the parties to a bareboat charterparty ,Chinese Maritime code shall enjoy priority in application. In the event that there are concerned provisions in Chinese Contract Code ,whereas there are not in Chinese Maritime Code ,the former shall apply.The thesis analyses and expounds the application of Chinese Contract Code upon the conclusion, force, performance, modification and assignment,and liability for breach of a bareboat charterparty, thus builds up the complete legal system of a bareboat charterparty.
