Research On Legal Aspects Of The System Of Maritime Lien

The aim of this paper is to clarify some basic legal problems on the system of Maritime Lien , one of the most characteristic legal institutions of maritime law. With a long history and rich content, it has developed mainly in common law countries, and comparatively our legal theory and system of maritime Lien is rather weak.Based on the discussion and analyze of the legal nature of maritime lien, the paper carefully selected some basic legal problems of maritime lien, including the relationships of the maritime lien , the enforcement and legal effect of maritime lien and the extinction .With the comparative way of study on both the common law and continental law countries system of maritime lien, the paper seeks to provide some useful suggestions to improve Chinese legal system of Maritime Lien .
