A Discussion On Construction Of China's Legal System Of Regional Autonomy For The Ethnic Minorities

The article expounds the course of the history in the construction of the legal system of regional autonomy of ethnic minorities in china, it's achievements and the problem in the course of the enforcement regulations about the law of regional autonomy for the ethnic minorities. It emphasizes how to put into effect the law in the development of the west in china, and put forth ten problems which we should pay more attention to. In order to persist in and make the system perfect, we should enforce the construction of the law. The article discusses the author's opinion from three parts.The first part expounds the process of the history from the Common Guiding Principle of 1949 to the amendment of 2001 about the legal system of regional autonomy of ethnic minorities. The process can be divided into three phases: (1) From the Common Guiding Principle of 1949 to the constitution of 2001. (2) The legal system of regional autonomy of ethnic minorities of 1984. (3) The amendment of the law of 2001.The second part discusses the achievement of the system of regional autonomy of ethnic minorities from the following aspects: the foundation of the system, the accomplishment of the legal system, the rapid development in autonomous areas, the establishment of the national legal opinion, and summarizes the major problems which arises in the course of the law being carried out.The third part expounds the relation between the Western China Development and the law of the autonomy, which is the emphasis of the article. Ten problems have been brought up in this part, which we should pay more attention to solve in the West Development and the autonomous law from the aspect of carrying the law out.The last part summarizes the construction of the legal system of regionalmautonomy of ethnic minorities in theory. The paper emphasizes that the Western China Development and persisting and perfect system of regional autonomy of ethnic minorities should be realized through legal means. We must strengthen the construction of ethnic minority legal system and provide the legal safeguard. Accomplish the law's value at largely extent during the course of Western China Development and realize its function, even make it perfect in the process of the market economy in ethnic minorities autonomous area.
