Study On Competition Law For Shipping Industry Of China

Competition is one of the most important systems in Market Economy. However, in the meantime of advancing the development of economy, it inevitably brings about monopoly and unfair competition. Therefore, the Competition Law holds very important position in Market Economy and is called the " Constitution of Market Economy" in western countries. Considering the characteristic of shipping economy and the diversity of shipping policy, we should not pursue the perfection of competition law for shipping industry blindly, but take the specialty of shipping industry into full consideration. Therefore, the thesis summarizes the common problems of competition law for shipping industry at first. Then on the basis of analyzing the characteristic of shipping economy and using the successful experience of European Union and USA fcr reference, the thesis elaborates the control methods of anti-monopoly in shipping industry from three aspects: i.e. anti-monopoly in shipping industry, exemption and the limitation to exemption. Meanwhile, in accordance with the situation of China, the thesis further discusses administrative monopoly. At last, the thesis expounds several unfair competition behaviors in shipping industry, for the purpose of providing theoretical foundation for the drafting "shipping law" with regards to the rules of competition in shipping industry.
