Study On The Anti-monopoly Exemption System Of EU Towards Consortia

In recent years, with the development of containerization of liner trade and the popularity of multimodal transport, the consortia as the most major organization of liner trade has became international liner trade industry or even the whole shipping industry’s important force which can not be ignored. Nevertheless, compare with the skyrocketing development of consortia, many countries including China do not have their very complete related legislation, especially for specific legislation of the Block Exemption System of anti-monopoly exemption. In this field, EU as the credo and one of the most active regions of consortia not only made detailed provisions of the concept of consortia and Block Exemption System, but also even put up the legislative regulation of special committee.Therefore, there are five parts in this thesis, excepting the introduction and conclusion.The first part of this thesis, that is to say, the first two chapters is the general concept and development status introduction of liner trade and consortia, especially illustrates the present situation of different countries’Anti-monopoly Exemption System to liner trade industry which all provided by their law.In the third chapter of this thesis, we study on the specific reasons why the liner trade industry could enjoy Anti-monopoly Exemption System from the economic perspective, Also study on the theoretical basis of EU antitrust legislation and to explore the economical theoretical basis of Anti-monopoly Exemption System of EU towards Consortia.The fourth chapter is the most important as well as the core of this thesis, it comprehensively analysis and illustrates each laws including general rules of the competition law and special regulations of consortia. Thus, the writer studies further the related provisions of antitrust Block Exemption System of consortia, mainly including the legislative basis, the content of exemption and the conditions of exemption.Another important content of this thesis is the fifth chapter which is also the last part. Through the above illustration and analysis, the writer does the comparative study between EU’s related provisions and some detail rules of Chinese general antitrust competition rules and related rules of consortia. Combine the development status and the future expectation of Chinese consortia, and learn from EU’s related legislative experiences, the writer puts up some related comments and suggestions for the specific provisions of Chinese consortia, especially for the Block Exemption System, and to expect that the anti-monopoly block exemption system would build up in China.
