This article results from the confusion both in knowledge and practice brought about from the orientation of testimony.In the system of criminal evidence,no one is the same as testimony which gives rise to such intense contention in the field of theory and practice.lt is no conclusion could be drawn in the jurisprudence and practice area that makes it essential to orientate the testimony theoretically.The testimonial standing varies from various social systems affected by different evidence regulations.Regarding the status of testimony,it is natural to discuss main factors influencing the testimonial standing in the system of criminal evidence/They are summed up as the purpose,value,and pattern of lawsuit,cultural tradition,judicial customs and so on.simply analysing these issues is no different from the castle in the air.By means of analysing the situation development of the testimonial nistoric standing,my research is to begin with the basic testimonial theory,together with my own judicial practice.The status of testimony and factors influencying its eridence standing differ apparently from China and west countries.The both aredistinguished by comparing each other.So,what and how to inprove testimonial regulations are readily solved in our Chinese law.
