In 2000, software industry has become the global first industry and without doubt in many countries it has been listed as the crucial industries pressing for development. Combined with government intention, the development of software industry has gradually become a drastic racing of enterprise's competition, citizen quality and economic policies and environment among countries. Under this background, the thesis will analyze some relevant topics from the economic angle, especially the protection of intelligent property, find out the economic base of them, give a reasonable demonstration, and offer my viewpoint and proposals.After introduction of the software industry situation, the thesis systematically analyzes the economic peculiarity of software, software market and industry, and emphasis the difference between software and material products. Introducing the economics of property rights and systematic economics, we delve the problem of intelligent property - the most important problem in software industry. Basing on the theoretical assay, using game theory, I make models to explore this problem and offer some policy proposals.The theoretical contribution of the thesis lies in that we not only point out the limitation of traditional microeconomic on the field of software industry problems, but also try to analyze these problems with economics of property rights and systematic economics. I take the software as an immaterial asset having public attributes. Non-market ways must be used to rectify these public attributes in order to develop software industry, but the effect of rectification is impacted by the transaction costs. That means the development of software industry has to greatly dependent on the protection of intelligent property from outside. So by economicanalysis we can offer some basis for drawing up the policies and laws to promote this industry, that is the realistic significance of the thesis.
