A Research On Legal System Of Chinese-foreign Rights Of Instruments

The right of instalments is an important kind of civil and commercial right,and emerges accompanying the development of commercial economy. The fast developing of market economy has promoted the wide utilization of instruments and the establishment of behavior regulations on instruments. Accordingly,the usage of instruments has also made great affection on the developing and perfecting of market economy. So some scholars just called instruments as "bleed flowing in the commercial exchanges' blood vessel".The thesis is extracted in my research. It begins with the fundamental introduce about the contents of the right of instruments,and still compares relevant stipulations between two foreign instruments' law systems. Basing on the behavior regulations about the right of instruments,the author has gotten some good inspirations after analyzing the contents of the right of instruments,researching the protecting methods to the right of instruments and exploring the legal ratifies about the right of instruments. Then the thesis further poses some instructions to amend defects of the right of instruments existing at present domestic legal system so as to do good to set up and perfect domestic legal system of the right of instruments.
