| In the recent 50 years,the economy of Taiwan has been developing rapidly,and Taiwan has become one of the famous "Four Asia Little Dragons",along with which the shipping business has developed and gained the achievements of world interest. All of these accomplishments have relations with the relatively perfect legal system of harbour and shipping management. Since carrying out the policy of reform and openness,on the basis of assimilating the advanced achievements of other countries in the world,and combining the situation in our country,the mainland of our country has established our own legal system of harbour and shipping management. This system conforms to the requirements of the reform and openness of our country and fits in with the development of socialist market-oriented economy,and reflects the international legislative trend of harbour and shipping management,so has its aspect of advancement and rationality,into which this paper will not inquire. Like anything else,the mainland legal system of harbour and shipping management has many defects inevitably,on which the paper lays special stress. The paper takes the comparison research method,inquiring the differences between the legal systems of harbour and shipping management in mainland and Taiwan,as well as the common ground of them. Such a comparison helps us to analyse the legal system of harbour and shipping management reasonably,and avoid the one-sideness in analysis. At the time when Shipping Law and Habour Law are being enacted,the author tries to compare the legal systems of harbour and shipping management in mainland and Taiwan,and analyse the similarities and differences between them,in order to find the deficiencies of the system in mainland,and seek some reasonable aspects of the system in Taiwan to use for reference. On the basis of the above study,the author imposes eight proposals with the hope to help the substantiation and perfection of the legal system of harbour and shipping management in mainland.
