Computer crime appears with the birth and using of computer so it's branded the characteristic of information times. Because of the distinct feature between computer crime and traditional crime and its rapid increase, it has been paid attention in a lot of countries of the world where they have drawn up some laws to control it. The study of computer crime is laggard in our country even though some legal items about computer crime were drawn up in new CRIMINAL LAW, but as a means of law regulation, CRIMINAL LAW is always lagged. Therefore, it is necessary to perfect the present criminal law for more efficiency to prevent and curb the computer crime.Hereby, by utilizing the achievements of international and national scholars and integrating the trend of computer criminal development, this article suggests both the concept of computer crime and the essential differentiation between computer crime and traditional crime after analyzing cyberspace made by computer. Moreover, through analyzing every kind of crime in the CRIMINAL LAW about computer crime, it put forward some suggestions to improve the CRIMINAL LAW in our country and build a new frame of the CRIMINAL LAW system about computer crime.
