Tort is illegal infringement of others' legitimate benefit including natural persons and corporation. While news review means that news review encroach on the right to human dignity of citizen and corporation in the course of writing and propagation.The latter causes great harmfulness to them and has negative effect in society. Compared with common tort, the infringement of news review is usually characterized by fast propagation, large coverage, and great harmfulness. Moreover it does greater harm to society than common tort. Once the infringement of news review occurs, it brings a particular relationship of right and duty between relative journalist and victim which demands the law to adjust.Though news infringement belongs in the field of tort,it wasn't took seriously until late 1980's in our country. The main cause of being paid great attention was for the popular interest in bringing lawsuits against journalists with the increasing of the civil rights awareness.According to the statistics, there were two booms for the news disputes from 1988 to 1989 and from 1992 to 1993.Since 1993, the impetus of lawsuits for news infringement are increasing. This phenomenon not only reflects the strengthen of the civil legal awareness and the reinforcement with regard to the supervision of the public opinion,but also indicates temperory imperfections of the protection statutes to the news rights and interests.Concerning to this aspect, it is a subject which is not to be ignored on the studying the news infringement on the news reviews in current mass media industry. It is beneficial to the writers to study the origin of the news infringement reviews earnestly; to find out the preventive measures on avoiding news infringement, to summarize the lessons from the infringement, especially to make it clear under which situations will cause infringement and which will not.In this way, the writers can write the news reviews correctly thus avoiding unnecessarily conflicts.This thesis tries to analyze news review infringement from the angle of law, and proves its harmfulness by numerous facts and cases.At the same time, it proposes how to take precautions against it.
