On Private Parties' Procedural Rights

The private parties' concept has already and gradually been accepted, as to it's proceeding more in-depth research will necessarily be further developmat of administrative law. When the idea of procedure has went deep into personal heart gradually, study on private parties' rights appears greatly important. The development of idea of procedural law and practice of procedural law provides a new cape for the research of private parties, namely, research of private parties' procedural rights. The position of procedural rights needs firstly be solved. On the basis of it, we need analyze its function, for clear and definite its position can't be replaced in theory and practice of administrative law. Because of plentiful procedural rights, we mainly study position of some important procedural rights in order to realize the balance between efficiency and fair. "Containing rights necessarily have to give relief',finally, preserving measures toward it are given. It is one last aim of drawing up administrative procedural law with respecting and protecting private parties' rights. It is the essential conditions of achieving administrative power that really realize and guarantee private parties' procedural rights. Only do this, the aim of exercising administrative power can be achieved which is protecting private parties' rights better by positively creating conditions of developing private parties' rights and not by negatively not violating private parties' rights.In the process of establishing administrative procedural law in our country, we should clearly regulate private parties' procedural rights in order to realize the ultimate purpose of performing administrative power, which is the respect of private parties' rights. As a kind of right not attracting enough attention, procedural rights will inevitably go deep into people's hearts with the development of idea of citizen' rights.
