In the last few years, with the gradual promotion of ecological environmental construction of our country, incidents of damage to people caused by wildlife have been taking place frequently. It is outstanding that the contradiction of the wildlife conservation with local citizen's vital interests has been becoming more and more serious day by day. Carrying on rational relief to the damage that the wildlife causes, not only concerns citizen's enthusiasm of protecting wildlife directly, but also concerns the success or failures of wildlife conservation and management in some region and involve the purpose issue of the conservation. However, our country's current system of relieving to the damage by wildlife has a series of problems, unable to ensure implementing the rational relief to the victim. These problems embody a concentrated expression: Because of the restriction of the specific historical condition, on the guiding theory of legislation, the state paid a little attention to the relief; On the legislation formal, the state law is too abstract and principle, the region legislation to be nearly a blank; On the legislation content, such as the subjects for relief to the damage, the composition of damage relieve responsibility, the principle that who should take up the compensation responsibility, the principle of relief, the way of relief, the reasons for exempting the responsibility, fund ensure of relief and procedure of relief, and so on, have no clear, rational regulation; The technology of the legislation lacked science. Problems like those indicate that the law system of the relief demands urgently being revised and perfecting. Analysis to the above problems, and combining the reality of our country, the corresponding perfection measures have been put forward in the thesis.
