The rural collective non-farming construction land transferece in this paper is that all levels of collective economic organization on township (town) and rural transfer the land use rights , which is requeised with rural households and township enterprises at law, to other entity on the principle of separation of the land ownership and use rights by tencancy and land use right stock share . At present, The rural collective non-farming construction land transfers principally by straight assignment and township enterprise modification and judicial decision, and acquires definite social performance. One is that it is benefit to the preservation of cultivated land; another is that depress the initial cost of construction land in favor of effective circulation of construction fund; the third is that protect fanner's benefit and collective land asset. It is that the development and perfection of market economy and countryship enterprises modification and the implementation of land use regulation change the environment of collection land use system, the system unbalance rising from system environmental change bring abundant potential income flow. The course of different action group pursing these potential income flow accelerate the innocation of the rural collective non-farming construction land transferece. The potential profit produced by system innovation is the unique dominant factor to induce rural collective non-farming construction land transference, and its maginitude decide the proceeding of this system change.3. the degree of innovated system plan depend on the assistance of state to innovation group in rural collective non-farming construction land transference.
