Studies On Administrative Sanction

The term "Administrative Sanction" has been accepted in the Administrative Legislation of China long before. The enforcement of Administrative Sanction System, however, is far from satisfaction. It is deviating greatly from what the term itself should reflect, whether it is reasonable to use the concept of Administrative Sanction to reflect a punishing and warning measure deserves a discussion. Based on an analysis of the concept, characteristics and nature of Administrative Sanction and the relationship between Administrative Sanction and the relevant concepts, this paper, combining some new thoughts on its history and current situation, makes it clear that the construction of Administrative Sanction System of China should cover its principle, executor, kind, procedure relief and other perspectives.
