Reeducation through labor, an important judicial system with Chinese characteristic, plays an role to some extent in consolidating the socialism regime, maintaining the public security and preventing and decreasing the ammonal out, by which it answers the process of the socialist construction. However, with the advcmcement of the principle of democratic and rule of low, many disadvantages of blush a system is arising gradually. Nowadays, it has already blocked our way -of rule of low, and has a bad Impact on the protection of civil rights and human right. In this paper, the author makes some analysis on the following aspects: the development, the disadvantages, the character and re-education of the system of reeducation through labour.In Part I, the author makes a full demonstration on the function of this system in the past by a whole explanation on its establishment, development and improvement. In Part I, the author makes a deep analysis on the reeducation through labor from its legal sources, entity and process.Then, he restrainedly draws conduction that system in existence was already lost its premise in both theory and low. In Part I, in order to make dear of the basis of the construction of reeducation through labor according to low, the couther first identity the character of this system On the base of fully demonstrating its character and extension the author divide it into two parts: administrative reeducation through labor and penal reeducation through labor. In part IV: the author tries to make a re-construction of our reeducationthrough labor system from both entity and process, hoping to rebuild a new system according to both low and the fundamental realities of our countries...
