Study On The System Of Reeducation Through Labor In China--And The Outlet Of Reeducation Through Labor

The system of reeducation through labor is b legal system created with special historic conditions in China. Its development has gone through the stages of creation, development, sabotage, and recovery and reform. The social function of the system of reeducation through labor has changed from arranging employment to maintaining the social peace and order. We don't deny the active function it had made to our society, however, the shortcomings of it has come out with the development of legalization and enforcement of the policy * of ruling-country-by-law. The system of reeducation through labor has existed for nearly fifty years, now it is facing doubt, criticism, reform, and even rejection. On the basic of studying the legal history of the system of reeducation through labor, this article compares the related legal system of reeducation through labor, and elaborates the outlets of the system of reeducation through labor.In all, there are four parts in this article: at first, according to the development of history, it studies the legal history of the system of reeducation through labor comprehensively; secondly, it compares the system of reeducation through labor of China to the system of security measures of foreign countries; thirdly, it analyses the legal shortcomings of the system of reeducation through labor from the directions of entity, evidence laws, and procedural laws; at last, it makes out a scientific solution, and points out the developing tends of the system of reeducation through labor in China.
