On The Remedial System To Supplier In Government Procurement

For governing the relations of government procurement, China has published a series of laws and regulations in succession since 1995. Among them, there are mainly local regulations. But, with the further deep of Chinese government procurement practice, the above legislation situation has become the obstacle to develop government procurement in china. China issued the government procurement law in 2002, which eases the dilemma of the legislation backward of government procurement in some degree. But we must complete the system of government procurement further, which is the critical factor to deep and popularize government procurement in china. The remedial system to supplier is the important part of the government procurement law, and the completion of the system is one of the important symbols of the perfection of the government procurement law. The article can be divided into five parts as below. The first part is the forward. The second part explores the basic theory of the remedial system to supplier, which purports to study its placement in the government procurement law and ideal for the aim of directing the demonstration study to the concrete remedial system in next part of the article. The third part studies the concrete remedial means on the base of the basic theory argued in the second part, which pays much attention to study the remedial systems provided by GPA and the model code. By the demonstration, the author concludes the best mode of the remedial system to supplier in government procurement. The forth part inspects the remedial system to supplier provided by the Chinese government procurement law on the base of the conclusion of forward two parts, and makes some corresponding legislature suggestions.
