Analysis On Means Test In Our Minimum Living Standard Security System

In our country, Means test is an important part of the minimum living standard security system, applying means test can help minimum living standard security management authority make right decisions and offer help to the impoverished inhabitants. With the government paying more and more attention to people's livelihood issues, studying means test can not only further realize its value, but also conducive to constant improvement of the minimum living standard security system.This paper is based on the analysis of the relationship between the minimum living standard security system and means test, describes characters, setting reasons and significances of the means test, and then explains importance and backgrounds of selected topic, introduces research status at home and abroad, illustrates research methods of this paper, summarizes the innovative points of this paper. This text is divided into four parts altogether: The first part is to analysis the property of means test. Using administrative investigation as starting point, introduces developing situation of administrative investigation in USA,UK, Japan, describes various definitions of administrative investigation, points out the position of means test in administrative investigation, summarizes means test type belonging in administrative investigation, then from the"administrative behavior stereotype"and"administrative process theory"two perspectives, discusses the property of means test in detail.The second part is to analysis existing problems and causes of the means test. Firstly introduces and explains five questions in detail which appeared in means test: verifying family income difficult, abusing of investigation power, poverty discrimination, lacking academic research, lacking legal norms, then based on each problem, analyzing the causes which lays the foundation for the perfection of means test.The third part is to make comparative analysis for means test of western countries and China's Hong Kong and Taiwan area. Firstly generally introduces social assistance system in USA, UK, Japan, Australia, Chile , Hong Kong and Taiwan region, and then makes comprehensive comparison from several aspects: means test agency, means test contents, income accounting rules, means test procedure, prevention of welfare fraud, finally from these comparisons extract something which worth our country means test use for reference. The fourth part is to give advices on perfecting means test. Namely, establishing means test basic principles, establishing professional means test agency, adopting scientific and reasonable income property accounting rules, reasonable regulating means test both sides'rights and obligations, perfecting means test procedure and relief mechanism, also points out the perfection of means test needs coordination of other aspects: reforming our country's social assistance system, perfecting our country's credit system, conducting employment assistance programs, disseminating healthy salvage culture.
