Monopoly In Software Industry And Government Strategy

Software industry is an important strategic factor concerning international competitiveness, comprehensive national power and martial power. Software industry has penetrated into every aspects of national economy, and dramatically promoted the reconstruction of the traditional industry, and contributed to the fast development of hi-tech industry. In recent years, our government has put forward a series of positive policies to facilitate the fast development of software industry. But besides effective policy support, a fair, orderly, efficient, and modest competitive environment is also essential for the fast and healthy development of software industry. Anti-monopoly is regarded as a main way to increase market competition, so how to apply anti-monopoly policy in software industry has become a big concern for the government all around the world.In this thesis, the author tries to put forward some new perspectives for our government's intervention in the software industry with knowledge from economics and latest law research achievements. First of all, the paper divides monopoly into two forms: monopoly structure and monopoly behavior, and makes some comparison between the two concepts. Secondly, the paper points out that there is some rationality in the forming of monopoly structure in the software industry by using the network economic theory to analyze the main factors contributing to the formation of monopoly structure. What's more, it analyzes the impacts that the monopoly structure has on the resource collocation, and concludes it is better to use soft interventions than the crude ones in monopoly structure; Last but not the least, it analyzes the major kinds of monopoly behavior and its impacts on resource collocation, and concludes that the monopoly behavior does more harm to the software industry development, so it is necessary to regulate this behavior; And based on the status of Chinese software industry, the author puts forward some constructive suggestions to regulate the monopoly structure and monopoly behavior in the software industry at the end of thepaper.
