The appearance of privacy right is due to modern civilization, although privacy derives from self-consciousness of the ancient human being. With the development of economic and information society, all kinds of man or unit, especially public organization, are easy to interfere in private realm by any means. People feel it is important to recognize privacy right in order to enjoy the peaceful and intimate private life in that condition. After the II world war, the Right Movement improving, international right treaty admitted that Privacy is the human right. Some countries also define the right to privacy by legislation or constitutional cases in the following year. The constitutional privacy right not only means that people put more attention from the outer-material world to inner-mental world, but also shows that it is indispensable to make use of the constitution to protect private realm and restrain the public power when the power is more strong than individual right. As a newly and abstract human right, there are several controversial arguments on privacy. Though people is aware of the relationship between the privacy right and human dignity, different culture and values bring about distinct private realm and individual life. The same country also exerts different understandings on privacy in different ages. Therefore the train of author's thought is to analyze fundamental points on privacy right including its appearance, substance, nature character, constitutional significance, perform principle and so on.In our country, there are a few and fragmentary rules on the right to privacy up to now. In view of the universal importance of privacy right and the transform of the governmental function, we should set up a more effective and integrated protecting system by every means as long as we can.
