On The Limits Of The Compensation For Spiritual Damage

In this paper, the author discusses the limits of the compensation for spiritual damage in different respects, such as the development of this system, the theories on this topic and the experience of introducing it into China. The main course of the compensation for spiritual damage is the limits related to both of the kind and the degree of the damage. Since the compensation for spiritual damage is not a universal method to dissolve the dispute, it has limitations in itself. The author believes that only the damages undertook by the natural person due to the torts, property or non-property, makes it necessary to apply the compensation for spiritual damage. At the same time, not only the simple civil cases but also the criminal or administrative cases produce the reasonable application of compensation for moral damage wherever it involves the damage to personal spirit.
