On The Requirement Of Standard Of Proof To Present Public Prosecution

Criminal standard of proof is one of the basic problems of evidence law, it not only relate some theory and principles of litigation, but also has an close relation about its practice. Criminal standard of proof is of most importance, the unity and fairness of judiciary ask it to be ascertained, and the principle rule of law need it on proceedings. Though criminal standard of proof is hotly debated in the law of evidence, its viewpoint is diversified, especially in the standard of proof of present public prosecution and guilt decision. So, this thesis demonstrate the requirement of present public prosecution from four aspects. First, simply introduce the conception of standard of proof, foreign criminal standard of proof and ours also introduced, second, discuss present public prosecution's special position and clarify the specialty of present public prosecution from comparison of foreign requirement; third, it lay more emphasis on the basis of present public prosecution; lastly, install, the "Two Fundamental" should be the requirement of our present public prosecution from theory and practice.
