On Criteria Of Death Penalty's Imposing

The criteria of imposing of death penalty mean all the conditions needed when a crime is going to be punished by death penalty. They consist of rules in general provisions of the Penal Code and rules in specific crimes of the Penal Code. The author points out the specialties of imposing of death penalty in different period and in different countries around the world. After analyzing the policy of imposing of death penalty and the conditions of imposing of death penalty in the Penal Code in China, the author thinks that the policy of imposing of death penalty should be expressed as more limits should be added on imposing of death penalty. There are many faults in the criteria of imposing of death penalty in the present code. The author thinks that we should reform the criteria of imposing of death penalty. The reformation of the criteria of imposing of death penalty can be attained by the right comprehension of the term ——the most serious crimes and the additions of more limits of imposing death penalty in the specific crimes of the Penal Code.
