Study On The Legal Protection Of Agricultural Intangible Assets

Agricultural intangible assets (AIS) is the main part of intangible assets. With the coming of Knowledge economy era, AIS gradually becomes the major economy resource for the sustained, rapid and efficient development of agriculture. However, the protection sense for AIS becomes indifferent in our country, and protection measure is powerless with the result that AIS is run off seriously. How to protect AIS is a urgent problem to study.Beginning with the fundamental problem of AIS, this paper uses the comparative analysis studying method, qualitative analysis and quantitative analysis method, and the combination method of theory analysis with practical application. Firstly, it sets forth the essential feature of AIS, 1A and IP, reveals the inherent relation within them, then explains the theory foundation and social law base of the AIS law protection. Secondly, it studies in detail the present legislative situation of IP at home and abroad making clear the law clause to AIS protection for reference in our country, and analyzing the extant problem and deep reasons in AIS protection in our country. According to all the above, it makes the institution and system of agricultural business and institution administration. Lastly, according to the different speciality of AIS, it apples the IP law system to push forward the tactics and countermeasure of AIS law protection.
