The General Exception Clause Of WTO

By invoking the General Exception clause of WTO, GATT XX, the parties of the multilateral trade mechanism are allowed to escape their responsibilities temporarily or partly on grounds of the economic security. On the other hand, the multilateral trade mechanism and the free development of global economy would not suffer from the abuse of it. By means of case analyzing approaches, the article analyzes the legal aim, main features, historic development and necessary requirements, needed by a successful invoking of GATT XX. In addition, try to find out the corresponding measures China should take to fight back the negative effect brought by the green trade barriers, which symbolize the current forms of trade protectionism based on the prediction of its developing trend in the future.
