From the beginning, the article simply introduces the basic theory about title to sue. It makes a definition for title to sue, makes a difference between title to sue and real rights, and analyzes the required elements of title to sue. Then, it turns to the title to sue under the international contract of carriage of goods by sea.For the convenience of the following text, the author discusses several concepts (Shipper, Holder of B/L, Consignee) and gives them a clear definition in order to resolve the disputes from the vague limitation between them. On this condition, the article discusses their titles to sue severally.The following part is the main body of this article. Through the analysis on English law and UNCITRAL's new draft on transport, the author makes a conclusion to the title to sue of international contract of carriage of goods by sea under our law system. And the author puts forward suggestions for the amendment of CMC.
