Analysis On The Law Applicable To International Products Liability

The thesis focuses on the international theories and latest development trend of law applicable to international product-liability. First, in order to interpret the conflict of laws of products liability, the thesis compares the main concepts of law of product-liability, such as "product, defects, person, the principles of product-liability and damage compensation". Second, from the perspective of applicable law of tort, the thesis contains the international theories and latest development trend of laws applicable to product-liability with a historical method, and the brief introductions about the content of The Convention on the Law Applicable to Products Liability. Finally, the thesis simply points out several disadvantages of the product-liability legislation in China, and then presents my own suggestions to improve the legislation of product-liability.The thesis consists of three chapters besides the preface and conclusion. In order to interpret the conflict of laws of product-liability, Chapter 1 introduces the conflict of laws on product-liability on the basis of comparing the relevant laws of industrialized nations, including America, Germany, Japan and China, Chapter 2 illuminates the law applicable to'product-liability. Chapter 3 points out the advantages of the present product-liability legislation in China and puts forward my own suggestions.
