Effect Of Inquisitional Body Report Of GATT/WTO

The effect of the report of GATT/WTO expert panel and appeal body is an very important issue at theory and practice, because it involves operation of solving the mechanism of GAIT/WTO dispute. This dissertation probes into the development of GATT/WTO dispute-settlement procedure policy orientation at first, and get a conclusion that the development from method of " power orientation " to method of " regular orientation " is an inexorable trend. Second, this dissertation explains the basic theory of expert panel and appeal body and discuss their status and function in the dispute- settlement. Then describes several possibility of the effect of the report of GATT expert panel, and do some analysis on the report and appraisal to it. Finally, it proves the effect of WTO expert panel and appeal body by using real example and methods of law.This paper includes four chapters besides introduction and conclusion. Chapter one, introduces the origin, development and relevant procedures of the expert panel, and describe the position in GATT/WTO dispute-settlement procedure of expert panel.Chapter two, introduces the establishment, utility, procedure of the appeal body, explain the method and privacy , and describe the role in practice of solving of the dispute of trial on appeal.Chapter three, introduces development and policy dispute of procedure of GATT, discusses GATT expert panel possibility that report render a service respectively, and analyse it.Chapter four, start with analysing the Japanese sake tax case, probes into the effect of the report of expert panel and appeal body. Then proves the effect of the report of the WTO expert and appeal body, and their effect to latter cases through the method of real example and law.
