Research On The Crime Of Loan Swindling

In the period of economic and society transformation, crime of loan swindling is one of the important crime forms in China. There are some faults in the articles of criminal law so as to cause many difficulties in the practice. This thesis elaborates a series of issues to solve those faults.This dissertation includes five sections:The first section addresses the crime of loan swindling, including the formation of legislation, the conception of the crime of loan swindling and the constitutive character.The second section addresses the study of the judicial application of the crime of loan swindling, including the test of crime and noncrime, the difference of this type of crime and that type of crime, criminal pattern, quantity of crime.The third section deals with how to find qualitatively the crime of loan swindling by danwei. This author advocates to investigate the person in charge into criminal responsibility.The fourth section issues the study of purpose of illegal possession. The author sets forth to explain in original meaning to solve the difficulties in practice.The fifth section addresses the study of perfect of legislation. The author advocates to regard the act of loan swindling and the act of escaping from paying for the debt as crime.
