Research On The Countermeasures Of The Crime Of Swindling Loan

With the rapid development of economy,crimes in the financial field are high and frequent.In recent years,the crime of swindling loans has caused great losses to banks and other financial institutions.The crime of swindling loans refers to the act of obtaining loans from banks and other financial institutions by means of swindling,causing great losses or other serious circumstances to banks and other financial institutions,In order to solve the problem of obtaining evidence for the purpose of illegal possession of the crime of loan fraud in judicial practice,and effectively control the act of loan fraud in the financial field,the low-level crime was added by the criminal law amendment(6)in 2006.This paper is divided into five parts: the first part analyzes the current situation and characteristics of loan fraud;the second part introduces the means of loan fraud combined with cases;the third part analyzes the difficulties of loan fraud investigation based on practical experience;the fourth part introduces the investigation countermeasures of loan fraud,It mainly includes mining criminal clues through data research and judgment,comprehensively obtaining loan information and identifying authenticity,querying funds through traditional methods and fund inspection and control platform,analyzing capital flow,providing evidence,conducting interrogation and inquiry in accordance with the law,and strengthening cooperation with other departments;the fifth part puts forward prevention and control measures according to the characteristics of loan fraud,including carrying out cloud attack and regional remediation actions,strengthen the construction of data system integrating fight prevention and control and establishing a precise interview mechanism for enterprises with loan risk.The author wrote this paper on the occurrence of multiple financial risks,looked to improve the point method as soon as possible,provided theoretical basis and practical guidance for this article,and completed the construction of a large number of integral parts to strictly crack down on the behavior of loan fraud,standardize the loan order and financial environment,and create a good environment for establishments.
