On The Research Of The Market Access Of Foreign Investment And It's Practice In Hunan

The foreign business investments in China is expanding quickly day by day ever since the opening up, therefore their influences on China's economy are becoming more and more significant. However, there are still quite a few differences between the market access of foreign investment policies of our country and that of WTO. So it is very important to adopt rational measures based on WTO principles to solve the problem now.On the background of liberalization of international investment and the present condition of China's attracting foreign investment, this dissertation deals with the market access of foreign investment in China, and summarizes the latest relative researches in and abroad. Based on the bilateral and multilateral protocols of WTO, the article analyses the related regulations on the market access of foreign investment in WTO' s Trade-related Investment Measures and General Agreement on Trade in Service. Then the article analyses the present legislative situation and already finished legislative reform of the market access of foreign investment in our country and puts forward the important meaning of the finished legislative reform, points out that there still exists variations between the relating legislation of China and protocols of WTO, and then compares the international conditions about the market access of foreign investment. On the ground of the above analysis, the writer proposes the basic legislative opinions: The economic basis resolves the superstructure, it means that the degree of the market access of foreign investment is decided by the economical level of the country and China should open the market of foreign investment step by step; the writer also poses the reformative countermeasures of the market access of foreign investment in China, such as Uniting the legislations on investment in and abroad, strengthening the legislations on international investment and so on. This article ends with a relevant practical case in Hunan province which is studied especially and have a important practical significance.
