Both the improvement of the Socialist Market Economy and the cultivation of citizen's legal view and credit conception need the system to be completed. Therefore, it is important in terms of both theory and practice to study the system.By using the methods of comparative analysis and case study etc. The thesis analyzes the current situation of the operation of the system of liability for fault in contracting, specially in the Continental Legal System, the Anglo-American Legal System and China. Then it summarizes the emergence and development of the system. And it further studies the concept, legal basis, constitutive requirements, responsible way and comparison of the liability for fault in contracting with related responsibility.The thesis especially researches the compensation scope in liability for fault in contracting, and strengthens its feasibility. It also analyzes the important role of liability for the fault in contracting in the Socialist Market Economy, and analyzes the application in reality.
