Discussion On Benefit Value Of Environmental Law

The fair sight, the interest sight, the safe sight under the sustainable development thoughts have been affirmed and developed as objective value in the value system of environment law, and gradually become the guiding ideology or principle of every country environment legal system construction and have entirely pushed forward the development of environment law. Taking a wide view of our country environmental law governing present situation, the effect is hard to be satisfied. And the inefficacy of environment law becomes the great concerned problem by people. In fact the inefficacy of environmental law is the deviating of value of law, namely that some laws deviate or violate corresponding value of law. The author thinks from the value of environment law that it derives from the support of the environment law benefit to purposefulness value. It is of important significance as for mostly preventing and reducing the environment law's inefficacy that we know the environment law value, rejust value system of environment law and persist in the beneficial law value. So this paper puts forward to acknowledging and emphasizing the important value of environment law - beneficial value. And beneficial value should be established in the next step of purposefulness value. Tracing back to the law philosophy origin of beneficial value, this paper analyzes its difference and contact between environment law and other value objective. By leading the thought of balance and play chess on the realizing plane of beneficial value, this paper discusses the adjustment mechanism of environment law and promotes the research of environment law system innovation in order to achieve the biggest benefit of environment law system governing function and realizes the sustainable development of mankind and the environment.
