Research On The Development Of Charitable Trust In China

Charitable trust is both a new concept and a new trust product to the Chinese market. When the ≤Trust law of the People's Republic of China≥was released, the lawmaker shows high attention to charitable trust by setting aside the whole sixth chapter dealing with what a charitable trust is and how to supervise it. In western developed countries, such as America and England, charitable trust has gained great success and played a critical role in their market economy society. However, in China, many people, and even some people who work in charity administrates bureaus still are not sure what charitable trust is. Therefore, it is very difficult for trust and investment corporations to develop charitable trust in China.This paper begins with defining the concept of charitable trust. In the process of research, empirical method and comparative analysis are applied. First we study the social-economic status and charitable activities in China, meanwhile, we also study the superiority of charitable trust system. Our results point out that it is essential to develop charitable trust in our country. In the second part, we make a research on some successful charitable systems of western developed countries, since we know that there still exist serious deficiencies in our society and in our present law system. At the end of the thesis, we put forward with several suggestions about how to improve our charitable trust system.
