The Protection Of State-owned Enterprise Property Right Full Transferring

With the reformation of our state-owned enterprise going further, people are having a clear cognition about it and laws, rules, policies which guiding restructuring of enterprise are becoming more perfect. The reformation of state-owned enterprise has a great development and change from either in form and in content, or in extent and in depth. The mode of the restructuring of enterprise changed from not touching the ultimate property right such as the following: contract management, leasing management, consigning management; to changing the ultimate property right such as the following: changing enterprise to be corporation, stock collaborating, changing creditor's rights into stock rights, selling, annexation and reorganization of enterprises.In the context of present macroeconomic policy, the structures and layout of the stated-owned economy are confronting with the fundamentally adjustment. State-owned economy should withdraw from general and competitive industries, be sold out or transfer the property right. This paper would concern about the interest body and protection of state-owned enterprise property right full transferring, and analyze the relationship between the right and obligation in the process of enterprise property right full transferring. This paper also discusses some issues about interest protection of buyer, seller, creditor and employee in relative chapters.
