Research On Drug Offenses

This research paper, which is divided 4 chapters, is concerned about the social harmfulness, constitution, criminal pattern, determination and penalty of drug offenses.In the first chapter, the author makes a general introduction to the drug offenses which covers the definition, the sorts, the characteristics of the drug and the social harmfulness of drug offenses. This reseach paper starts its discussion from the special social harmfulness of drug offenses.The second chapter is concerned about the consistitution of drug offenses which includes the object, objective elements, the subject ,subjective elements of such a crime .In this chapter, the author specially discusses the social relationship harmed by drug offenses, the act of perpetrating in the objective elements, the difference between drug offenses committed by the unit and drug offenses committed by single persons, and even that commited by group, at the same time ,the deliberation in the subjective elements and the intent in the constitution of such a crime are also discussed in detail.The third chapter is concerned about the criminal pattern of drug offenses. In the chapter, the author focuses on the accomplishment and unaccomplishment of drug offenses, tne constitution of joint drug offenses, the nature of the acts commited by buyers and sellers and the acts, even the theory of one crime or plural crimes constituted by one act.The fourth chapter covers the determination and penalty of drug offenses. The auher focuses on the conviction of the acts trafficking false drugs and adulterating drugs and even the native of the acts luring to trafficking drugs. The meaningfulness of the quantity and quality to the conviction-determination of such a crime and the special recidivist to drug offenses are also discussed in detail .In the end ,the author presents different opinions on the Article 347 stipulated in our criminal law and gives his own legislative suggestions.
