| The right to know on the environment is that the nation has the right to know the environmental conditions of their countries and the world, the national environmental management conditions and their own environmental conditions. This kind of right is the premise for the citizen to participate in the national environmental management, and at the same time it is the necessary democratic procedure to environmental protection. It produces and develops on the basis of environmental right with the environmental problems being more and more serious and claims of environmental protection being heater and heater. Its produce has a certain background and basis: environmental democracy is the political basis; the prevention of environmental invasion and relief are the social basis. Its subject is extensive, including both human being and social organization; the object is environmental information; its contents are abundant, that is: the right to know, the right to apply for, the right to obtain help, and the right to get relief. The right to know on the environment is one of the contents of environmental right and is the procedural right to realize environmental right. It has the use to control right and has multiple law values, which are efficiency value, freedom value, justice value and sequence value. So when it produces, it gets the attention from many countries and the internation. A lot of countries issue special environmental law, regulation, direction, convention or refer to the right in the law of the freedom to information, administrative procedural law and environmental basic law etc. The international society is without exception. As for our country, though the right to know on the environment gets more and more attention, its starting is a little later, and also it has its own defaults, the path to develop will be rough. So after being analyzed the principle problems which are existed for the time being, it is inevitable to prospect its future on the basis of drawing on the experiences and lessons from other countries. |
