Study On The Enforcement Of Agricultural Administrative Law

The 15th Conference of CPC established the basic principle of rule by law, and administration by law is the core of rule by law. The enforcement of administration is an important content of administration by law. As an important part of the administrative enforcement system, the enforcement of agricultural administrative law is a new task of the transition of agriculture administrative departments in the market economy environment. It is necessary for the demand of socialist market economy development and a fundamental way to solve the current problems of agriculture, countryside and farmers, to strengthen the research and construction , to provide a better legal environment for the agricultural investment of capital, technology and the production, supply, sale and transportation of agricultural products.In this thesis, the author defines the basic concepts and main characteristics of the enforcement of agricultural administrative law in theory and analyses the development and achievements of our country's enforcement of agricultural administrative law, on the basis of which the author examines the main problems in the current enforcement of agricultural administrative law: 1. the imperfect legislation; 2. insufficient transition of ideas and function of agriculture administrative departments; 3. shortage of regulations on the subjects of the enforcement of agricultural administrative law; 4. insufficient procedures for regulating the enforcement of agricultural administrative law; 5. the relatively low quality of administrators; 6. the lack of perfect safeguard system on the enforcement of agricultural administrative law; 7. the imperfect supervision system of the enforcement of agricultural administrative law.Having analyzed the causes of the above mentioned problems, the author puts forth a preliminary plan to strengthen and perfect our country's enforcement of agricultural administrative law: 1. to further perfect the legislation; 2. to strengthen and improve the system of the enforcement of agricultural administrative law; 3. to restrict the inside regulations on the process of the enforcement of agricultural administrative law; 4. to improve the comprehensive qualities of administrators; 5. to perfect the system of supervision and safeguard the farmers' legal rights and interests.
